Frontier Communications

The HOA Board signed the five-year bulk internet-only agreement with Frontier on July 31, 2020. Installation is estimated to begin on November 1, 2020, and will take about four months to complete. According to the agreement, Frontier will install all 3,450 homes by March 1, 2021, and that is when the five-year term will begin.

To recap the basic provisions of the Frontier plan:

  1. It is a five-year internet-only plan.
  2. It is $12 per month (with a 5% increase per year).
  3. All residents will have to participate and pay the $12 per month. There are no opt-out provisions for any residents even if they do not use the Frontier internet service.
  4. The internet speed is 500 Mbps upload and 500 Mbps download. This is the fastest speed currently available.
  5. The contract includes a wireless router/modem, and there is no installation fee to the resident.
  6. You may install at a later date at no charge.
  7. TV plans are available if residents want to purchase them directly from Frontier.
  8. A phone line is available that you can purchase directly from Frontier.
  9. A resident may purchase any TV plan from any provider. There is no requirement to purchase TV plans from Frontier.

This process began over one year ago, and so many people helped to bring this project to its conclusion. We need to take a moment and say thank you to all these volunteers for donating more than a year of hard work. We started with the Bulk Cable Committee consisting of Linda Aasen as Chair, Gene Gonzalez, Steve Aasen, Jurgen Gross, Wally Barbour, Rich Rodeman, Armando Gomez, Rick Stohr, and Robert Israel.

Once we had chosen a service provider and begun contract negotiations, a few more people stepped up to make sure the HOA was proceeding responsibly and reviewed all the contract terms before we made a final decision. So we also need to thank Bill Wethe, the chair of FAC, and attorneys Bob Jester, Bob Israel, and Fera Mostow who helped guide us through the maze of legal terminology. Thanks to all of you for donating so much of your time.

We will be sending residents a schedule of when to call for an installation appointment. As you can imagine, we cannot have 3,450 homes all call on the same day. So we will phase in the installation appointments.

I have asked the FAC to review and recommend a one-time increase in next year’s HOA fees, beginning January 1, 2021, to reflect the increase for the Frontier contract. It will cost the HOA more money if we increase dues during the year. The most efficient method of implementation is to have one price increase in January so that dues stay the same all year long – even though the installation process will begin by November 1 and finish by March 1. Otherwise we will have increased costs to change the dues amount during the year plus increased costs to print and distribute new coupon books. This would also cause more confusion for auto payments if the dues amount were to change in January and then change again in March.

The HOA will also have some up-front installation charges as we pay for the people that are installed during the four-month installation period. The HOA will be getting a bill each month from Frontier for the homes that have been installed. But we are not able to charge those homes a fee until we are able to assess all homes once everyone is installed. Because our governing documents do not permit us to charge different homeowners a different monthly dues rate, we need to start everyone at the same time at the same rate per month. By increasing dues in January for everyone instead of in March, we resolve these issues and can pay for all the partial installations over the four-month period.

This will mean some homes will be installed before the dues increase, and some homes will be installed after the dues increase on January 1, 2021. This was the only way to finalize the terms of the contract given the limitations of our governing documents.

Hopefully, this answers the basic questions as we move forward with the Frontier internet bulk cable contract installation. It will be good for the HOA to have locked in a $12 rate for internet service for the next five years, which equates to a savings for each homeowner of about $50 per month.

I would like to answer the most frequently asked questions:

  1. When can I install the Frontier service? Everyone will be sent an install schedule so each home will be scheduled to call for an appointment between November 1, 2020 and February 2021. You will call for your install appointment on the date listed in the schedule. You may call after this date, but not before.
  2. When will the install schedule be sent out? We estimate the install schedule to be sent out on October 1 by regular mail, email, and posted on the website.
  3. If I already have Frontier service will I need to have an installation appointment? Yes. Most homes do not have the equipment to handle the faster speed of 500/500. It is estimated that 90% of Frontier customers will need new equipment installed.
  4.  I already have Frontier installed so can I convert to the new HOA contract price right away without having to wait for an appointment? No. All residents will be on a schedule for install based on geography in the complex. Frontier will start at one end of the complex and keep installing until complete at the other end. Even if you have Frontier equipment now you will have to wait for your scheduled time to make an appointment for install and at the time of install you will be converted to the new pricing.
  5. When will the $12 per month fee go into effect? We anticipate the monthly increase will begin on January 1, 2021.
  6. If I am not installed by January 1, why are my dues being increased on January 1,2021? Assuming Frontier completes the install by March 1 here is the calculation for monthly dues to cover your monthly Frontier internet service. You will notice that you are not paying any more money than if we started billing on March 1:
    1. If we start billing on March 1, that will mean $12 per month for 10 months, March through December. That totals $120 for the year.
    2. If we start billing in January at a rate of $10 per month that equals $10 x 12 which equals $120 for the year. Notice that this is exactly the same amount of money.
    3. We also need to add in installation charges and notification charges which total about $1.13 per home per month.
    4. Since we don’t know for sure when Frontier will finish the install, if Frontier finishes installation early, by February 1 instead of February 28, there will be an additional increase per month of $1 per month per home.
    5. Total of all combined costs is between $11.13 per month to $12.13 per month.
    6. Given these costs it is anticipated increasing HOA dues starting January 1 by $12 per month to cover all costs and possibilities.
    7. It will mean some homes will be installed before the dues increase begins and some homes will be installed after the dues increase on January 1, 2021. This was the only way to finalize the terms of the contract given the limitations of our governing documents in not charging different prices to different homes. So, to have a smooth transition all year no matter what happens, starting the dues increase in January is exactly the same cost no matter when a person is installed.
  7. Can I keep my existing TV service if I want? Yes. The HOA Frontier contract is for internet service only. Each resident will decide on their own what TV service they would like, and you may purchase TV service from any company you wish. You are not required to buy TV service from Frontier. So, you could have Frontier internet service and Spectrum TV service as an example.
  8. Am I required to install the Frontier internet service? No.
  9. If I do not install the Frontier internet service do I still have to pay the monthly fee of $12? Yes. All residents will pay the monthly fee of $12 per month which will be part of your HOA monthly dues even if you don’t install the service.
  10. If I order TV service from Frontier, will I pay the HOA for the TV service? No. Any extra services for TV or phone will be billed to you directly by the company. The HOA monthly dues amount will only include the $12 for internet service.
  11. If I am unavailable for my scheduled appointment what happens? You may call any time after your scheduled appointment to make an appointment for installation. There is no charge to install the Frontier internet no matter when it is installed.
  12. I am in Canada and might not be able to be in the area for one year. What happens? The same answer as #11, you may call any time after your originally schedule appointment to make a new appointment. This could be done one, two, three years later and there would still be no charge to install the Frontier internet when you want.
  13. I have heard the Frontier TV plans have gone up in price, is this correct? Yes. As we stated in the Town Hall meetings, pricing on TV packages was not guaranteed. We will hopefully send out the TV package pricing for Frontier when we send out the schedule for appointments. Some of the packages currently don’t exist and some of the packages have doubled in price. We suggest you investigate all companies and their TV service before making a decision on which TV package and service to purchase.
  14. Am I required to purchase a TV plan from Frontier? No. You may buy TV service from any company you want, or you may choose not to buy TV service at all.

Assuming Frontier completes the install by March 1 here is the calculation for monthly dues to cover your monthly Frontier internet service. You will notice that you are not paying any more money than if we started billing on March 1:

Besides the monthly costs, the HOA must pay $36,600 for the installation. This can come from contingency, it can come from operations, but it must be paid by the HOA. One option is to put a line item in the budget for $36,400 for next year. This would mean an .89 cent increase to the monthly dues (in addition to the $10 explained above).

There will also be the cost to the HOA of communicating by mail with the residents about the installation schedule. This cost is estimated to be .24 cents per month per home to let residents know what is going on and when they will be installed by a schedule. This cost is estimated to be $10,000 ($2.90 per home for the year or .24 cents per month per home). The resulting total monthly cost to the homeowner for next year’s budget is estimated at $11.13 ($10+ $.89+ $.24) with this scenario-Frontier finishes by March 1 and we start dues increases in January.

The above calculations assumed that Frontier would finish by March 1. If, however, Frontier finishes by February 1, we must pay $12 per month beginning in February. This calculation results in the paying $132 ($12x11) for each household during the year. The resulting total best estimate for monthly cost per Homeowner under the scenario if Frontier finishes by February 1, 2021 is $12.13 ($11+ $.89+$.24).

It will mean some homes will be installed before the dues increase begins and some homes will be installed after the dues increase on January 1, 2021. This was the only way to finalize the terms of the contract given the limitations of our governing documents in not charging different prices to different homes. Finances and Frontier

Given all that has happened, I would like to update you on the financial impact the pandemic has had on our operations along with what is happening with the Frontier plan.

Bruce Marley needed to resign from the Board. We will miss his presence and appreciate his many contributions. We are fortunate that Bruce will continue as a member of the Finance Advisory Committee. We are also fortunate that Carey Thompson was willing to step up and take Bruce’s place. There is no one more qualified to take over as Treasurer, and our sincerest thanks go out to Carey for her help during this time. Our situation just got a whole lot easier and more positive because of her efforts.

Because so many of you have asked about our finances and the possibility of a special assessment, I thought I should let Carey explain the current financial situation:

Yes, it’s true, I’m back as your HOA Board Treasurer. Why did I agree to return to the board? Following a 30-year career in state government, I have never abandoned my commitment to public service. Since my Board term expired three years ago, I’ve been an active member of the Finance Advisory Committee; so I’m up to speed on our current financial position.

The good news: there is no need for a special assessment. Our current annual forecast of operating results projects an unfavorable variance of just $25,000 compared to the 2020 annual budget.

Our revenue shortfalls have been offset by significantly reducing our expenses. Over the past several months, the Board, Troon, and DRM have done an excellent job in managing expenses during this pandemic crisis. Operating revenue is forecast to be down by $959,000, while expenses are forecast to be reduced by $934,000 -- thus a $25,000 increase in the operating deficit to $356,000. The 2020 budget was based upon a $331,000 operating deficit reflecting an $8 per unit per month credit in 2020 for the operating fund surplus from 2019.

The Board, along with the assistance of the Finance Advisory Committee, will continue to closely monitor our results of operations and financial position. We pledge to maintain our community’s excellent operations as well as our strong financial position.

I have been asked quite often about the Frontier Communications contract because Frontier has filed for bankruptcy. This was not unexpected. Frontier filed for Chapter 11 bankruptcy but said its service to customers will not be affected by the financial restructuring.

We have met with the reps from Frontier, and for them it is business as usual.

We will be finishing our contract negotiations and, if the terms are acceptable, will sign a five-year contract as presented to the residents.

We are hopeful we can finalize the agreement with Frontier and begin installation by late August or early September. It will take about three to four months to complete the install.

  2. It is $12 per month.
  3. All residents will have to participate and pay the $12 per month. There are no opt-out provisions for any resident even if they do not use the Frontier internet service.

Please help all of us stay safe by being responsible about your behavior during all activities. Masks and social distancing are the keys to our health and safety.

This is still a most beautiful place, and I can’t think of anywhere I would rather be. Clearly, it doesn’t get any better than this.

President’s Message: Indoor Pool & Masks

Good Afternoon Residents:

I have received complaints about some people not wearing a mask when entering the Indoor Pool area. Masks are required everywhere indoors. I have also received complaints that some people are not exiting through the designated door but are exiting through the door where they entered. These are not part of the Indoor pool guidelines and put people at risk. Staff has been warning people that they must wear masks and comply with the guidelines if they want to use the Indoor pool.

We must all work together to make sure we do everything possible to keep everyone safe and healthy. That means following the guidelines that are in place. Given current statistics, the more we can do to limit exposure and contact by wearing masks and social distancing the better for all of us.

I have instructed staff that beginning tomorrow there will be no more warnings for not following the Indoor pool guidelines. If a person enters the pool area without a mask they will be cited. If a person leaves through the entry door instead of the designated exit door they will be cited. We would prefer not to cite anyone, but the warnings for some people are not working, and everyone’s safety is more important than personal convenience.

We are also asking that if you are not going to attend at your reservation time, please cancel 24 hours in advance so others may use the pool.

President’s Message: No Gatherings

Good Evening Residents:

More and more information is coming out about the spread of the virus in our area. It is clear the virus is growing quickly and is all around us. In Sun City Palm Desert in just a little over two weeks the virus has grown from 10 cases and no deaths to 21 cases and 1 death. The City of Indio as grown from 15 deaths to 34 deaths and the County of Riverside cases have grown from 11,694 to 19,450, and 395 deaths to 479 deaths.

This pandemic is far from over and the only focus at this point is to practice what works, no gatherings and wear a mask when outside. I am urging everyone to follow these simple instructions to keep all our friends and neighbors alive.

I have been told of a possible gathering at 9 am within our complex. This is not the time to celebrate by gathering, this is a time to celebrate responsible behavior to keep our friends alive. This is real and all around us, so I am urging everyone to please stay home. I have the name of the person that has organized this event, and that person will be cited for every person that shows up. To plan and invite a gathering during this time is selfish and irresponsible considering the facts of the situation. It is also a violation of the State Order. Ladies and Gentlemen, this virus can kill you, and it is spreading quickly in our area. There is a reason the County is pulling back on re-opening plans, let’s listen carefully as to why.

I wish you all a safe and healthy weekend. Let’s look out for each other by not gathering or socializing during a time when that action could lead to an extremely negative outcome. At this point there is nothing more important than the health and safety of our neighbors and friends. Please act like they matter. If you have a gathering planned, do the responsible thing, and cancel it. You will look in a mirror later and be thankful that you helped everyone be safe.

President’s Message: Shadows

Good Afternoon Residents:

Shadows Restaurant:  I need to clarify my statements on the podcast today. Shadows is closed for sit down dining only. All else remains the same, it is open for takeout and delivery. When the County ordered restaurants closed it was for sit down dining only, take and delivery is still available.

So, nothing has changed for Shadows, as you all know Shadows is currently open for takeout and delivery. This Service will continue, we are just not opening for sit down dining.

I hope this clears up the misunderstanding. So be sure to order take out from Shadows. It helps all of us and helps to keep staff employed.

As I also explained the Fitness Centers will be closed until further notice. Please be careful while enjoying the holiday weekend. Remember, fireworks are not allowed in this complex.

Given these crazy times that none of us have experienced before, it is easy to forget how much we truly can be thankful for. A neighbor greets me with a “good morning,” I smile and reflect on the gift of this paradise. It is a pleasure meeting, talking, and working with so many great people. Even in the middle of a pandemic, we need to count our lucky stars.

Today I would like to take a moment to thank some of the many people who are doing so much for our community. It is easy to forget all the people who work hard to make this place a paradise. So many people on so many committees give their time so we all benefit. Too often, residents will think it is the Board that does all the work; but the members of each committee are putting in much of the effort. All these members make the difference between success and failure in creating a beautiful place to live. I thank them all for making the work of the Board so much easier.

If you know a committee member, stand up and recognize them. We can’t say it loudly enough or often enough, given their dedication. Thanks to all the committee chairs for their service and unselfish dedication:

So much happens so quickly. To get the most up-to-date information as soon as possible, you need to sign up for the email blast system. Using this, we can email messages directly to you from the HOA. The podcasts I have done, the brainchild of Robert Firring, are also distributed through this system. The news articles in The View are submitted only once a month, 30 days in advance; and, given current circumstances, a lot can happen in 30 days. If you sign up for the email blasts, when we send out new information, you will get it that day. The fact that there are more than 1,000 downloads for each podcast shows we are communicating quickly with those residents about how we are doing and any changes that are coming our way.

To sign up for email blast messages, please fill out the form on our community website. We are not allowed to send you messages without your permission. There is also a form you can complete if you want your email information to remain private. The more residents we sign up for this email communication, the more we are able to keep you up to date with everything that is happening here at Shadow Hills.

Once again, when the sun sets on this day, I will reflect on the beautiful sunrise, a good morning greeting, all the kind people who have gathered in this community, and again say to myself, “It doesn’t get any better than this.”

President’s Message: Gym Opening Delayed

Good Afternoon Residents:

The gym opening will be delayed one week, so it will open on July 6. I will give a podcast at 3 pm and go into details.

  1. A staff person was not feeling well, sent home, and was then tested for the virus and the test was positive. As a result, some staff members have been sent home to self-quarantine and be tested. We want to get the results of those tests before opening the gym because we need some of these staff people back to work in order to open the gym.
  2. This extra week will also give staff more time in resolving questions and concerns as people register for the online reservation system.

Remember, beginning tomorrow, to make reservations either by phone or online, it all begins at 10 am for every activity. The desk will start taking calls for reservations at 10 am, or you can go online at 10 am. Phone in reservations will stop at 4 pm. Online reservations will stop at 11 pm.

Here is an overview of current activities and guidelines.

The State Order is still in effect about ‘Stay at Home’ and ‘No gatherings.’ Residents are responsible to follow the State Order. The HOA will not be looking for violations of the State Order on private property. We will investigate any complaints of noise or conduct on private property. The HOA will be looking for and enforce no visitors and no gatherings on Common Property, such as streets, parking lots, etc.

If a resident is walking with a child, they can be cited for violating State Order because a young person is not supposed to be visiting and they are on common property. If walking, biking, etc. on common property with guests including on streets, you may be cited. We are not looking for such violations on private property, for example in your home or in your backyard.

  • Masks are required everywhere Indoors. Masks are not required outdoors as long as you can maintain social distancing of at least 6’ apart. If you can’t maintain social distancing of at least 6’ apart a mask is required.
  • Social distancing of at least 6’ is required both indoors and outdoors at all times.
  • Montecito Outdoor Pool is closing June 24-July 1 for deck repair work.
  • Residents have requested that everyone who walks on side streets please walk on the side of the street facing traffic.
  • Board met to determine opening guidelines of Club Facilities going forward:
    • Golf
      • Montecito Putting Course remains closed.
      • North and South Course Putting Greens will be open for practice beginning June 18 at 10 AM. Putting Greens are open from 10 AM till dusk.
      • Driving Range will be open for practice beginning June 18 at 10 AM. Driving range is open from 10 AM to 1 PM. You still need to pay $10 to practice on the driving range.
      • Driving Range tee at the South side of the driving range is closed – You may not take balls to the South side of the driving range.
        Montecito Practice chipping area is open anytime, but you must use your own balls. You may not take range balls to this practice area. Social distancing is required at all times.
      • No split tees for golf.
      • No water-bring your own.
    • Pools:
      • Montecito Indoor Pool will now have 5 lanes instead of 4. Walkers should use lanes 1 and 2.
      • Beginning 6/24 new pool hours will be: 6 AM-6 PM. This keeps consistency with gym hours, accommodates staffing, and allows for maintaining cleaning supplies.
      • Santa Rosa Pool – no change. 1 person at a time, or multiple people from the same household. If you are not a high-risk person, please use Montecito Pool so high-risk people can swim without risk.
      • Montecito Pool – After deck repair, 4 people will be allowed in the pool at one time. Social distancing (6 ft apart) is required. This is 4 people, not 4 households. If you want to swim with someone else in your household, you must make separate reservations for the same time.
      • No gatherings around the pool. You must leave complex after swimming. No chairs, no sunbathing.
      • Since there will be 4 people permitted in the Montecito Outdoor Pool, reservation time periods for this pool will be for 1 hour instead of the ½ hour used previously. There will be a 15-minute break between reservations for staff cleaning.
    • Dog Parks
      • The Dog parks will open on June 23, 2020. Reservations will be taken beginning June 22, 2020.
      • Reservations can be made up to one-week in advance.
      • One reservation per day per person.
      • Reservations can be made by calling the Lifestyle Department at 760-345-4349 ext. 2120, Monday – Friday 9:00 AM – 4:00 PM. You may only make reservations by phone.
      • Dog Parks Hours of Operations:
        • November 1st – March 15th: 7:00 AM – 5:00 PM.
        • March 16th – October 31st: 7:00 AM – 8:00 PM.
      • Maximum of four (4) people in each dog park section, total of eight (8) persons at a time per dog park.
      • One person equals one reservation.
      • 25-minutes reservations only.
      • Social distancing is required at all times.
      • Per CA State Code, people in California must wear a face covering when outdoors and cannot maintain a 6’ foot social distance.
      • All chairs in dog parks will be removed.
      • Water Fountains are unavailable.
      • If during the day the dog park is empty you can use it without reservation. However, if 4 people do come in and have reservations you must leave.
      • We recommend wearing masks in dog parks.
    • Gyms
      • Gyms will open on 6/29.
      • Montecito Fitness Center is limited to 18 people.
      • Santa Rosa Fitness Center is limited to 12 people.
      • Reservations for 60 minutes maximum.
      • Make reservations up to one week in advance.
      • We are not taking reservations until 6/26 because the system will not be set up until then.
      • Only one reservation per day per person.
      • Masks required at all times.
      • No fitness classes for now.
      • Hours: 6 AM – 6 PM.
      • 30-minute time limit on cardio equipment.
      • Lounge chairs will be removed because no gathering rules are in place.
      • All small equipment will be removed.
      • Only small equipment left: dumbbells and small dumbbells.
      • Please exercise and leave so next group can come in.
    • Online Reservation System
      • An online reservation system is being created and ultimately will be used for all Lifestyle events as well as dog park, gym, pools, etc.
      • The on-line reservation system and the phone-in reservation system will have the same start time to make reservations.
      • We will send out instructions on how to create an account for the reservation system and how to use it.
      • Once your account is active you can make:
      • Reservations one week in advance.
      • 1 reservation per day per person.
      • You must have a separate account for each person who wants to make reservations.
      • Need to cancel 24 hours in advance so that others can use the time.
      • Failure to cancel could result in removal of online rights.
      • You will still be able to call in to make reservations, but it will not be as efficient.
      • Please be aware that Dog Park Reservations will be call-in only for now.
      • Eventually the on-line system will allow for payment of Lifestyle activities on-line.
    • Shadows
      • Shadows will remain status quo with takeout and delivery service only. No sit-down dining.
    • Clubhouses
      • Clubhouses are still Closed – No Activities in the Clubhouses – No events until further notice. We do not know when the Clubhouses, indoor activities, or events will open.

Remember:

Masks are required indoors at all times. Not required outdoors.

At least 6’ social distancing is required at all times, indoors or outdoors.

If you are high-risk please be aware and stay home.

If you are high risk and want to swim use the Santa Rosa Pool. If you are not high risk and want to swim outside, please use the Montecito Pool to allow the high-risk people to swim.

Masks: As I explained in yesterday’s Podcast, the State issued new guidelines for wearing masks outdoors. The simple version is ‘Californians must wear face coverings when outdoors if 6’ social distancing cannot be maintained’. For all activities outdoors, except swimming, you must wear a face mask if you cannot maintain 6’ apart. If you can maintain 6’ apart then a mask is not required. Please be responsible and aware of what you are doing. Occupants of the same household do not have to maintain 6’ social distancing and don’t have to wear a mask.

Dog Parks: Will open June 23, 2020 with reservations. Once again, you must remain 6’ apart at all times if you are not wearing a mask. Here are the guidelines for the dog parks:

The Dog parks will open on June 23, 2020. Reservations will be taken beginning June 22, 2020.

Reservations can be made up to one-week in advance. Reservations can be made by calling the Lifestyle Department at 760-345-4349 ext. 2120, Monday – Friday, between 9:00am – 4:00pm.

Dog Parks Hours of Operations:   November 1st – March 15th – 7:00am – 5:00pm.
March 16th – October 31st – 7:00am – 8:00pm.

  1. Maximum of four (4) persons in each dog park section, total of eight (8) persons at a time per dog park.
  2. One person equals one reservation.
  3. 25-minute reservations only. That leaves 5 minutes to exit before new group comes in.
  4. Social distancing is required.
  5. Per CA State Code, people in California must wear a face covering when outdoors and cannot maintain a 6’ foot social distance.

  8. Patrol will periodically monitor the dog parks for violations.

Shadows Restaurant: As you all know Shadows is currently open for take out food only. The Food & Beverage Committee has been evaluating opening Shadows for sit down dining on a limited basis per the County Guidelines. The Board has decided at this time to maintain the status quo and not allow for sit down dining for a variety of reasons.

  1. First priority is resident health and safety.
  2. Opening of other activities has been outdoors where health and safety have less risk.
  3. Sit down dining is not able to maintain 6’ social distancing at a table.
  4. You cannot wear a mask while eating.
  5. SCPD had to close the restaurant after virus was contracted by an employee.
  6. If restaurant closes so does the take-out food have to close. Problem is all staff would have to stay home and self-quarantine for 14 days.
  7. Cases of Coronavirus are climbing in this area.

The Board felt at this time patience is warranted given all the points listed above and to take a wait and see approach is in the best interest of the health and safety of all residents. Please use the take-out and delivery service from Shadows and the Board will be evaluating the situation daily.

Clearly, I don’t know what month this is, or as Bob Israel explained to me, I must have had one too many margaritas before the Podcast. He is probably right. I have been getting a lot of questions about the dog parks, specifically why can’t the dog parks open?

Why can’t we open our dog parks when other dog parks are opening including the City of Indio dog parks? I can’t speak to how or why other areas decide to open a dog park. I will give you the current information available to us as to the guidelines for dog parks.

You can walk your dog. You can go to the vet or pet hospital if your pet is sick. Remember to distance yourself at least six feet from other pets and owners.

Here is exactly what the CDC says about dog parks:

Walking a dog is important for both animal and human health and well-being. Walk dogs on a leash, maintaining at least 6 feet (2 meters) from other people and animals, do not gather in groups, and stay out of crowded places and avoid mass gatherings. Do not go to dog parks or public places where a large number of people and dogs gather. To help maintain social distancing, do not let other people pet your dog when you are out for a walk.

Given this information I can’t tell you why the City of Indio has opened their dog parks, but they may do as they wish. Given that the HOA is responsible for all Common Areas including dog parks, the Board has decided at this time the dog parks need to remain closed. The Board does not believe dogs can maintain the distancing requirement of staying 6’ apart from other dogs and/or people.

Hopefully, this answers your questions about dog parks for the moment. As soon as we get new information, we will review it and let you know. Please be patient, we can only move forward based on what the State Order will allow. I guess the good news is any dog owner may go the City of Indio dog park and use them during this time that our dog parks must remain closed.

A Message from Your Treasurer

With all the financial questions about the HOA and how the “Stay at Home” directive has affected us, I thought it appropriate we take a moment to listen to our Treasurer, Bruce Marley, as he oversees the financial health of our HOA. Keep in mind this article was submitted on May 5, 2020. Please stay healthy and safe. And now, Bruce Marley’s letter:


Greetings, fellow neighbors of Sun City Shadow Hills Community Association (SCSHCA). The intent of this communication is to describe where your HOA is financially and to highlight the measures our management company, Desert Resource Management (DRM), and our onsite manager for Golf and Food/Beverage operations, Troon, are taking in response to the COVID-19 pandemic.

Both DRM and Troon have already taken significant steps to reduce costs, while at the same time ensuring that our community is well maintained and ready for when this pandemic comes to an end. Please note that we continue to ensure resident safety by maintaining our security at full strength and to preserve the quality and ambience of our common areas, both deemed essential by the Board.

Entering this unprecedented challenge, our community’s financial resources were among the strongest in the valley! As of December 31, 2019, our financials show SCSHCA as having $2,158,205 of working capital on hand, equal to 2.80 months of Operating Fund monthly assessments. This is a good thing. Industry measures suggest from 1 to 3 months should be on hand. The 2.80 compares to 1.20 on December 31, 2017, and 2.05 on December 31, 2018. As you can see, the Board has worked to increase this key measure and, while no one could have anticipated COVID-19, we find SCSHCA in a good position to get through this challenge.

The 2020 budget preliminarily forecast year-end (December 31, 2020) working capital of $1,827,005, equal to 2.34 months. The decline is because the Board decided to reduce your 2020 dues to the current $273/month, from the balanced budget of $281. We made this decision because we had the ability to do so, and we wanted to keep dues reasonable while retaining our solid working capital position. This working capital will be used to offset increased expenses, so monthly dues are not expected to increase in 2020 as a result of the pandemic.

Adding to the ongoing financial strength of SCSHCA are two significant aspects of our structure. One, we continue to collect monthly dues of $273 from our 3,450 homeowners, which totals $941,850 per month. Two, we have over $13,000,000 in our Reserves/Replacement Fund. While the monthly dues may vary slightly if some homeowners are unable to make their payments, our current delinquency rate is less than 1%. As for Reserves, while these funds are set aside for specific Common Area replacement needs for many years to come, it is reassuring to know we have “money in the bank.”

So, with that in mind, here is what we are doing right now to account for the significant anticipated shortfalls for Golf and Food/Beverage (Troon) and to control costs in general (DRM):

Troon

At this very early point in time, Troon is forecasting that combined losses directly attributable to the pandemic will add over $300,000 to budgeted 2020 losses associated with these golf and food and beverage. If you might recall, the monthly budgeted subsidy for these two components was approximately $40/month per residence. This $300,000 equates to $7.25/month per residence, which will be paid for out of working capital as previously mentioned.

DRM

Our management company immediately made cuts to some maintenance areas like housekeeping, especially because both clubhouses are shut down, along with other areas that will not require ongoing attention. Additionally, there were cuts in the AV (audio visual) area, along with cuts in the Fitness Department.

Summary

I hope you have found this useful. Please remember three things:

  1. All figures used in this article are subject to further review and audit. I intend to provide updates on an ongoing basis as we learn more.
  2. These decisions by Troon and DRM have affected over 50 employees spread between those two companies. We are all in this together, and I ask that you think about all the employees of Troon and DRM who are struggling with the decisions that were made and consider supporting the local food banks and other such services.
  3. Chances are we will be dealing with COVID-19 through May, given current “government” words and actions. We will be looking closely at all areas of expense as needed, while at the same time working to preserve and protect the quality of our amenities.

President’s Message: Survey Question

Hello Residents,

There has been much discussion about residents having visitors at their home. Many people would like to have visitors and the Board has been discussing this issue given the current situation with Covid-19 and the State law which prohibits visitors at this time.

Currently the State Order is: “To protect public health, I as State Public Health Officer and Director of the California Department of Public Health order all individuals living in the State of California to stay home or at their place of residence….”. There are exceptions printed in the State Code which allows for golf, walking outdoors, biking, Tennis, etc. There is no exception for having a visitor or gathering in your home.

According to legal counsel the HOA Board may not override or change this directive, it is currently a law punishable by fine and/or imprisonment. It means we do not have the authority to change the Order by allowing for example 4 people to gather on a driveway. We are not allowed to give permission to let you have a guest over for a visit. The HOA is required to follow the State Law and Codes, that is clear in our governing documents.

The only thing the Board may do is decide if we are going to cite a person if a violation occurs. That decision is within the authority of the Board. The Board is meeting on Friday at 2 pm and wants an answer to the following survey question:

Given that the State Order says no gatherings or visitors at any home, do you want the HOA to cite residents for violating this State Order at their home?
Yes or No?

A ‘Yes’ vote will mean the HOA will cite for violations, a ‘No’ vote would mean we will not cite for a violation.

We will close the survey at noon on Friday so the Board will have the information for their meeting at 2 pm. You may only fill out one survey per home, all duplicates will be removed in their entirety.

President’s Message: Frontier Communications

Good morning residents,

We are in the process of negotiating contract terms with Frontier. Although that can take some time we are still proceeding forward. Hopefully, we will reach an agreement soon. In our discussions with Frontier, because of the Covid-19 issues it is not projected to start the install process until at least August. It will still take 3 months to install everyone once the install process starts.

As you all know, Frontier filed for Chapter 11 bankruptcy and is in that process now. The Finance Advisory committee is monitoring that process very carefully to be sure the HOA has all the information needed so it is fully informed. Thank you to Bill Wethe, the committee Chair, and the committee for spending all the time to watch out for our best interest.

The Finance Advisory Committee has been monitoring financial and other reports prepared and filed with the SEC by Frontier Communications Corporation (Frontier).

Earlier this month, Frontier prepared and timely filed its financial report (Form 10-Q) with the SEC for the quarterly period ended March 31, 2020 on May 6, 2020.  Frontier also prepared and filed with the SEC its Form 8-K on May 1, 2020 and another Form 8-K on May 15, 2020.

President’s Message: Coronavirus Update – 5/11/20

Good Morning Residents:

The County has issued new guidelines for swimming pool use dated May 6, 2020. I have attached those guidelines. The County has also issued a new Health Orders dated May 9, 2020. I have attached those new Orders effective May 9 for your review.

 

 

In reviewing the swim guidelines, the Board decided that some changes may take place regarding swimming in the three pools.

Swimming pools: The pools will operate a little different beginning May 18. The guidelines allow for more than one person in the pool at a time.

Outdoor Pools: The Board has decided that the Santa Rosa pool and the Montecito outdoor pool will remain the same with only one swimmer at a time. The exception is the new guidelines allow for the occupants of the same household to swim together at the same time. So, when you make a reservation for one of the outdoor pools, occupants of the same household may swim together provided you give both names when you make a reservation. We will need to verify that the two people listed to swim together at the same time are occupants of the same home. All other restrictions will remain the same.

Indoor Pool: Because there are lane lines in the Indoor pool, four people will be allowed to swim in the Indoor pool at the same time, only one person per lane. We will begin taking reservations for the 4 people at the same time in the Indoor pool on Monday 5/11, and allow four people to swim at the same time beginning Monday 5/18. If you like to walk in the pool, you will want to reserve lanes 1 or 2. All other restrictions will remain the same.

Reservations are on a first come first serve basis and you need to call for a reservation.

The new County Orders state the County is rescinding many of the past Orders and will now rely upon the State rules during this time of the ‘Stay at Home’ directive. The Board will be meeting on Tuesday to discuss how this will impact our HOA. We are not sure at this time, so we are checking with legal counsel to discuss our responsibility in implementing the new Orders. Hopefully, we will be back to you by Wednesday with more information.

Currently the following rules are in place. Let me go through the different activities to update you on what is open, what is closed, and what requirements are in place:

Golf: Golf courses are open, and masks are not required outdoors. Masks are required indoors. All other restrictions, including no social gatherings, are still in place according to these guidelines. There are no guests allowed.

Golf Course is closed to all activities except for golfers while playing golf: Per the HOA rules there is no walking, jogging, biking, or dogs allowed on the golf course at any time.

Tennis, Pickleball, Bocce: These activities are open with the same restrictions, including no social gatherings, except masks are not required outdoors. There are no guests allowed.

Stay at Home Order is still in place: This means no guests and no gatherings of any size in any venue. You may not invite over non-essential guests to your home.

Gym: May not open by State and County order.

Fitness Classes: May not happen by State and County order.

Clubhouse Games and Activities: All Clubhouse activities are closed per State Order.

Driving Range, Practice Area, Putting Greens, and Putting Course: These are all closed for use except for golfers that are going to play golf. Golfers may arrive at the area 30 minutes before tee time to use these facilities.

Dog Parks: Dog parks are closed per State Order. This is because the State Order requires all dogs to be 6’ apart at all times.

Basketball Court: Board decided to close the Basketball court to maintain social distancing with other activities in that area.

All clubhouses are closed except for the business Center in the Montecito: Only the business center is open in the Montecito Clubhouse. All other activities are closed.

HOA Office: The HOA office is open by appointment only. You need to call to make an appointment for essential requests. All other requests will be done by mail only.

State Recommendation: “A strong recommendation is made that all persons who are 65 years old or older, have a chronic underlying condition, or have a compromised immune system self-quarantine themselves at home”.

So far, we know of no known case of covid-19 in the complex. We will need to practice the social distancing rules very carefully to help us all avoid this virus. We all need to continue to Stay at Home and not invite any guests into our homes either from inside or outside the complex.

We are part way home, but please stay focused, diligent, and responsible. By keeping our eye on the ball, we will hopefully get through this without a single case of the virus within our community.

President’s Message: Coronavirus Update 5/1/20

Good Morning Residents:

The County has issued a new order regarding health and safety guidelines that may be implemented effective May 1, 2020. I have attached the two orders from the county for your review. In following these directives, the Board decided that masks are no longer required while outdoors, but you always need to carry one. Masks are required everywhere indoors. Let me go through the different activities to update you on what is open, what is closed, and what requirements are in place.

 

Golf: Golf courses are open, and masks are not required outdoors. Masks are required indoors. Please review the attached procedures when playing golf. All other restrictions are still in place according to these guidelines. There are no guests allowed.

Tennis, Pickleball, Bocce: These activities are open with the same restrictions except masks are not required outdoors. Please review the attached procedures for reserving and playing these sports. There are no guests allowed.

Golf Course is closed to all activities except for golfers while playing golf: Per the HOA rules there is no walking, jogging, biking, or dogs allowed on the golf course at any time.

All clubhouses are closed except for the business Center in the Montecito: Only the business center is open in the Montecito Clubhouse. All other activities are closed.

Swimming pools: The pools will open according to attached procedures on May 4. Only one person at a time may swim for 30 minutes. Please see attached procedures if you want to swim. Reservations are on a first come first serve basis and you need to call for a reservation.

I want to thank everyone for your cooperation to help make SCSH safe as we get through this time. So far, we know of no known case of covid-19 in the complex. Good Afternoon Residents:

The County has issued a new order regarding health and safety guidelines. I will give more details this afternoon in a Podcast, but effective immediately masks or face coverings are no longer required outdoors. You are required to always have one with you. Masks or face coverings are required everywhere indoors except in your own home or in your own car. Gatherings are still not allowed no matter the size or venue. So, no visitors to your property at all.
