What Does Our Association Law Firm Do?

The Homeowners' Association, under the direction of the Board of Directors, has a firm of attorneys to represent us regarding compliance with all applicable governing documents, i.e. Covenants, Conditions & Restrictions (CC&Rs), Bylaws, Rules and Regulations, Design Rules, Club and Group Rules and Collection Policy.

The attorneys also provide legal counsel regarding statutory laws dealing with our entity such as the Civil Code (Davis-Stirling Act), Corporation Code, Internal Revenue Code and more.

Their services include, among other things, general counsel services, enforcement of the governing documents and amendments, legal opinions on many varied matters...vendor/subcontractor contracts, assessment collections and legal action to enforce collection, when necessary.

Sometimes counsel becomes involved in litigation and/or dispute resolution involving the Association. A recent example occurred when Counsel filed a complaint alleging shoddy workmanship on the part of a contractor on the property. Shortly before the case went to trial, Counsel settled for a substantial amount which more than covered the cost to repair the poor work and attorney fees.
