I was contacted by the DA’s office and charges have been filed against Ceasar Larrach. He will be arraigned at the end of the month.

It is the DA that decides if there is enough evidence to justify prosecution; the HOA is not part of that decision, and it appears the DA is going forward with prosecution because charges have now been filed.

Some residents have asked why isn’t the HOA named as the ‘Co-Complainant’ in this case.   The case against Ceasar Larrach is a criminal embezzlement case, so the HOA would not be a party named in the complaint.  Specifically, I have been told by the DA’s office that the HOA would never be a “co-complainant in the embezzlement case” because this would never happen in a criminal case.

Rather the State of California, through the Riverside District Attorney, files criminal complaints in Riverside County on behalf of the People of the State of California.  The DA said the case would be listed as ‘The People of the State of California vs. Ceasar Larrach’.

While the HOA followed a responsible and timely process by gathering evidence through an audit once we thought there was a possible crime, the criminal case is in the hands of the DA.  It is not up to HOA to decide or direct how the DA will proceed regarding the criminal charges against Ceasar Larrach, nor would the HOA be listed as a complainant.

I will let you know more information as it unfolds and we are informed by the DA.
